J. Ms. Korenstein - Student Discipline Policy (Waiver of Board Rule 72) ADOPTED AS
AMENDED

Whereas, During the past year there have been a series of fatal and near fatal shootings by students on school campuses across the nation.

Whereas, The Board of Education of the City of Los Angeles is committed to providing safe and violence-free schools to the fullest extent possible;

Whereas, The possession of firearms and other guns contributes to unsafe schools, injuries, and even death;

Whereas, Students, parents, and school personnel have expressed serious concern regarding their physical safety and well-being as a result of some students possessing firearms at school;

Whereas, When students have guns at school there is a serious disruption of the educational process, which adversely affects students' achievement;

Whereas, Students who are recommended for expulsion for gun possession are afforded a hearing before an expulsion review committee, the panel which makes final recommendations to the Board of Education;

Whereas, It is imperative that students who are recommended for expulsion for having guns in their possession be placed in alternative programs, not on a regular school campus, during the interim period while they await a final decision by the Board of Education; and

Whereas, Assembly Bill 922, authored by former Assembly Member Barbara Friedman, amended the Education Code to require districts to ensure that all expelled students be provided an appropriate educational setting; now, therefore, be it

Resolved, That all secondary students who are recommended for expulsion for having guns in their possession be removed from regular schools and transferred to alternative educational programs while they await a resolution to their expulsion proceedings, except as otherwise precluded by law;

Resolved further, That the Superintendent direct staff to create additional elementary and secondary alternative educational programs as needed, such as Community Day Schools (CDS's), for elementary students who have serious social adjustment problems, including students who are expelled;

Resolved further, That the Board of Education go on record as supporting AB 1845, which would increase funding for District operated CDS's;

Resolved further, That the District actively pursue legislation which would authorize districts to place all students who have had guns in their possession in appropriate alternative educational programs; and be it finally

Resolved, That, the District provide the necessary resources for staff development, training, program implementation and administration to carry-out the goals of this policy.

The Board of Education will receive a revised Office of the Superintendent No. 2 regarding presentation of contract proposed by PG&E Energy Services/CH2MHill regarding air conditioning of various District schools and related energy conservation measures.
