P. Mr. Tokofsky - Motion to Establish an Office of Inspector General (Noticed November 3, 1997) Discussed in Business and Operations/Personnel Committee FAILED

Whereas, The Los Angeles Unified School District projects one billion six hundred million dollars ($1,600,000,000) annually in business, construction, and consulting contracts for the next 10 years, adding an additional approximate four hundred million dollars ($400,000,000) in voter-approved Proposition BB funds;

Whereas, Such funds should be allocated in the most cost-effective basis that prevents tax dollar waste or abuse; and




Whereas, The District wishes to avoid even the appearance of lax controls over these new expenditures; now, therefore, be it

Resolved, That the Board of Education of the City of Los Angeles establish the Office of Inspector General and appoint an Inspector General to a term of office of five years, which may be renewed once for a total of 10 years; and be it

Resolved further, That the Board of Education of the City of Los Angeles convene a panel of at least three members of the Association of Inspectors General to screen and recommend candidates for the selection of an Inspector General; and be it

Resolved further, That the selection panel use the following criteria when making their selection: That the Inspector General shall have verifiable experience in criminal investigations and prosecutions, the conducting of audits, public administration, conflict of interest and campaign finance laws, and any additional skill or knowledge necessary to carry out the duties and responsibilities of an Inspector General; and be it

Resolved further, That the Board of Education of the City of Los Angeles shall select the Inspector General from the candidates recommended by the panel of Inspectors General; and be it

Resolved further, That the Board of Education of the City of Los Angeles establish policies and procedures for the removal from his or her position as Inspector General if 1) a two-thirds majority of its members votes for the removal; or 2) if the Inspector General is found to have violated a state or federal law or regulation, local ordinance, or a policy or practice of the Board, relative to ethical practices, including, but not limited to, the acceptance of gifts or contributions; and be it

Resolved further, That the Board of Education of the City of Los Angeles define the duties of the Inspector General as being responsible for auditing and investigating any and all matters regarding the operations, activities, construction, and expenditures of the Los Angeles Unified School District, the Board of Education of the City of Los Angeles, District and Board staff, and District contractors and subcontractors. The authority of the Inspector General shall also include investigation of possible conflicts of interest, improper communications with Board Members on potential contracts before contract awards, or other ethical violations and be it

Resolved further, That the Inspector General shall have subpoena power as authorized by state and local codes or granted powers and the Board of Education of the City of Los Angeles acknowledges that any investigatory file compiled by the Inspector General is an investigatory file compiled by a law enforcement agency subject to disclosure pursuant to subdivision (f) of Section 6254 of the Government Code; and be it

Resolved further, That the Board of Education of the City of Los Angeles direct the Inspector General to establish procedures to require that a prequalification questionnaire be completed by each construction company, engineering firm, consultant, legal firm, product vendor, and any other business entity seeking to contract with the Board for the furnishing of goods or services. The Board will establish policies and procedures to prohibit the District from entering into a contract or doing business with any firm that knowingly provides false information on the questionnaire.

The questionnaire shall solicit information regarding the firm including, but not limited to the following subjects: (1) Experience; (2) Quality and timeliness of past performance; (3) Reliability and responsibility; (4) Compliance with wage, hours, and other fair labor practices; (5) Compliance with equal employment requirements; (6) Subcontractors used by the firm; (7) Integrity of the firm and its key personnel; (8) Gifts given, or contributions made, to members, alternate members, or employees of the Board; (9) Lawsuits filed against the firm and their dispositions; and be it

Resolved further, That the Inspector General shall, at a noticed public meeting of the Board of Education, report quarterly on the following: (a) School construction, design, and repair contracts, including expenditures on such projects for consultants, attorneys, developers, and construction firms; b) Expenditures of funds allocated by Proposition BB and any future bond measures approved by the voters for school construction, design, or repair; (c) Travel, meals, and refreshments, private club dues, membership fees and charges, and any other expenditures which are specified by the Board; (d) A report on savings or recommendations for savings; and be it

Resolved further, That the Board of Education of the City of Los Angeles fund the Office of Inspector General using existing District resources, which may include redirecting funds which would otherwise be allocated to the Independent Analysis Unit or the recently established Special Audits Branch.

Q. Mr. Tokofsky ­ Support of Girls and Women in Accord with Women's History Month (Noticed
February 9, 1999) Discussed in Legislation and Cities, County and Community Relations Committee ADOPTED

Whereas, The legacy of war in Afghanistan has had a devastating impact on the civilian population;

Whereas, The warring factions in Afghanistan have routinely violated the rights of women and girls;

Whereas, There has been a marked increase in human rights violations against women and girls since the Taliban militia seized the City of Kabul in September 1996;

Whereas, Prior to the Taliban's arrival, women in Afghanistan were educated and employed: fifty percent of the students and sixty percent of the teachers at Kabul University were women, and seventy percent of school teachers, fifty percent of civilian government workers, and forty percent of doctors in Kabul were women;

Whereas, Afghan women are now forbidden to work outside of the home. Prior to the Taliban takeover, women worked outside of the home in various professions, including employment as doctors, professors, and civil servants;

Whereas, Afghan girls and women are prohibited from attending schools and universities. Before the takeover, 50 percent of the students in Afghanistan were women;

Whereas, Afghan women are forbidden from appearing outside the home unless accompanied by their father, husband, brother or son;

Whereas, Access to health care has been denied to the majority of Afghan women and girls. This is a result of prohibiting male doctors from examining women, prohibiting women physicians from practicing and limiting the health facilities available to women;

Whereas, Afghan women are required to be covered from head to toe in a shroud called the burqua with only a narrow mesh opening through which to see when they leave their homes. Likewise, they are not allowed to wear shoes that make any noise when they walk;



Whereas, Homes and other buildings in which Afghan women or girls might be present must have their windows painted so no female can be seen from outside;

Whereas, Afghan women have been whipped, shot at, beaten, and, at times, killed for not adhering to these restrictions;

Whereas, Islam put forth the pioneering values of protecting women's human rights, and put forth a Muslim woman's birthrights to education, expression of opinion and thought and to inheritance,

Whereas, The Taliban militia's actions directly contradict the teachings of Islam,

Whereas, The Secretary of State of the United States, the United Nations, and the Physicians for Human Rights have reported that the Taliban's targeting of women and girls for discrimination and abuse has created a health and humanitarian disaster;

Whereas, The International Red Cross, the Red Crescent and the United Nations estimate that more than 500,000 people in the City of Kabul, approximately two-thirds of the residents of that city, depend on international aid to survive;

Whereas, Afghanistan recognizes international human rights conventions such as the Covenant on the Rights of the Child, the Convention on the Elimination of All Forms of Discrimination Against Women, and the International Covenant on Economic, Social, Cultural Rights, all of which espouse respect for basic human rights of all individuals without regard to race, religion, ethnicity, or gender;

Whereas, Denying women and girls the right to an education, employment, access to adequate health care, and direct access to humanitarian aid runs counter to international human rights conventions; and

Whereas, Peace and security in Afghanistan can only be realized with the full restoration of all human rights and fundamental freedom, the voluntary repatriation of refugees to their homeland in safety and dignity, and the reconstruction of Afghanistan; now, therefore, be it

Resolved, That this body stand in support of Senate Joint Resolution SJR4 introduced by Senator Hilda Solis and co-authored by Senators Alpert, Figueroa, Karnette, and Speier and by Assembly Members Davis, Jackson, and Kuehl; and now, therefore, be it

Resolved further That the Los Angeles Unified School District urges the President of the United States and Congress to not recognize any government in Afghanistan that systematically violates the rights of women and girls, and urges the United States government to do everything in its power to restore women's human rights to education, work, health care and safety in Afghanistan, including pressuring all outside powers to stop funding the Taliban Militia.

R. Ms. Castro (Waiver of Board Rule 72) ­ El Dia de los Niños ADOPTED

Whereas, Children are the nucleus of the family unit;

Whereas, Families should have an established day to value their children and celebrate their childhood;

Whereas, Families, communities and the generations that follow are committed to providing a positive family, social and educational environment for children;

Whereas, "El Dia de los Niños" will serve to bring attention to issues related to children including poverty, abuse, illiteracy and safety; and


Whereas, This day will bring communities nationwide to celebrate and uplift all children and ensure they are first in our lives and have a future in the next millennium; now, therefore, be it

Resolved, That the Board of Education of the City of Los Angeles declare April 30, 1999, as "El Dia de los Niños," throughout the District; and be it

Resolved further, That the Superintendent be directed to urge schools to participate in activities to promote "El Dia de Los Niños."

S. Mr. Tokofsky ­ First Annual Cesar E. Chavez Walk Los Angeles (Waiver of Board Rule 72)
ADOPTED
Whereas, The First Annual Cesar E. Chavez Walk Los Angeles will take place on Saturday April 17, 1999, with the goal of increasing public support for the United Farm Workers of America and also preserving the legacy of UFW founder Cesar E. Chavez.

Whereas, The UFW is continuing in the efforts that Cesar E. Chavez started by organizing farm workers in California's strawberry fields to bring about dignity and opportunity to over 20,000 strawberry pickers.

Whereas, Cesar E. Chavez continues to be honored and remembered by Americans across the country with the naming of schools, streets, buildings, and other dedications. And that the Cesar E. Chavez Foundation works with individuals to preserve the legacy of Cesar E. Chavez by instilling Chavez' philosophies of non-violence, volunteerism, and public action in youth across the country.

Whereas, The students, staff and officials of the Los Angeles Unified School District have been invited to join other public agencies, community organizations, and individuals to support this worthwhile cause; now, therefore, be it

Resolved, That the Board of Education of the City of Los Angeles endorse the voluntary participation of its employees and students in the First Annual Cesar E. Chavez Walk Los Angeles to be held on Saturday April 17, 1999‹a five kilometer walkathon starting and ending at Cesar Chavez Avenue and Soto Street‹as an important humanitarian and educational activity.

JJ.Ms. Korenstein ­ Recognition of May as National Teen Pregnancy Prevention Month and Support of Teen Pregnancy Prevention Programs

Whereas, Teenage pregnancy significantly affects the educational, health, and economic future of adolescents;

Whereas, The undesirable consequences of teen pregnancy can include greater health and developmental risks for babies, additional barriers to educational attainment for teen mothers and fathers, additional challenges to their economic viability and psychological well-being, and increased risk of subsequent teen pregnancies;

Whereas, The Los Angeles Unified School District supports the efforts of a variety of State and locally sponsored teen pregnancy prevention programs working with our students and families, including four programs funded by the California Department of Education (S.B. 1170) in the Bell Cluster, the Grant Complex (Madison Community Collaborative), the Jordan/Locke Cluster (Watts School Community Pregnancy Prevention Consortium) and the Los Angeles Complex;

Whereas, The Pregnant Minor Tax Force continues to advocate on behalf of BOTH services and programs to support the school success and graduation of pregnant and parenting students AND Teen Pregnancy Prevention and Comprehensive Health Education efforts to stem the tide of early pregnancy and parenthood among our youth; and

Whereas, The month of May has been designated as National Teen Pregnancy Prevention Month as part of the National Campaign to Prevent Teen Pregnancy; now, therefore, be it

Resolved, That the Board of Education of the Los Angeles Unified School District recognizes the month of May as National Teen Pregnancy Prevention Month, supports the prevention efforts of the teenage pregnancy prevention programs active in District Schools, and commends this observance to our school community; and be

Resolved, That the Board of Education recognizes the tireless efforts of the Pregnant Minor Task Force in working to support Teen Pregnancy Prevention, in establishing the Pregnant and Parenting Teen Programs Office, and in supporting educational programs and services to insure the school success and full participation of Pregnant and Parenting Students and the healthy development of their children; and

Resolved further, That the Board of Education supports the continued availability of comprehensive pregnancy prevention programming and comprehensive health education presented in develop mentally and culturally appropriate ways for all students of the school district.
