- Pursuant to the request of the Chair of the Joint Legislative Audit Committee (JLAC), the
Board of Education will consider in Closed Session the recommendation by staff and
counsel that the District formally request a State audit with respect to all documents and
issues, confidential or otherwise (including attorney-client documents), related to the
Belmont Learning Center project, the Ambassador litigation, and other matters currently
under investigation by the Chair of the JLAC. These documents were, in whole or in part,
the subject of a similar request in the context of the above-referenced litigation. The
authority for the Closed Session includes the above litigation provision of the Brown Act,
as well as other sections which may apply, including, but limited to, Government Code
Sections 54956.9(a), (b)(1), and 54956.8.
- Should the Board of Education agree with the recommendation of staff and counsel, a
formal audit by the Office of California State Auditor would be requested and the District
would fully cooperate with the State Auditor and make available all documents, including
confidential and privileged attorney-client communications, in accordance with the
procedures established by State law for such audits.
- Anticipated Litigation
- Pursuant to Government Code Section 54956.9(b)(1) and (c), the Board of Education will
receive the advice of counsel with regard to the administration of student achievement tests
and the District's obligations under state and federal law.
- PLEASE NOTE: The Board of Education will publicly consider this issue at its Special
Board meeting at 4:00 p.m., February 17, 1998.
- Pursuant to Government Code Section 54956.9(b)(2)(B), the Board of Education will
review with legal counsel the effect of Proposition 209 on the programs, policies, and
practices of the District, including but not limited to the Integration Program and the court
order in Crawford v. LAUSD.
